Federal Court Orders Freedom of Kilmar Abrego Garcia from ICE Detention
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks lawful basis.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.
The case stems from a mistaken deportation to El Salvador in March, which the government later admitted was an error. Following his repatriation to the United States to face alien smuggling allegations, he was detained in immigration custody.
In her decision, the court pointed out that the authorities lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
Context of the Case
The court proceedings center on conflicting claims. Whereas the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this claim.
He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing criminal case in Tennessee.
Conditions of Release
The judge, who was overseeing his petition to removal in a Maryland district court, ruled that he must now comply with the conditions of his bond from jail in Tennessee. This decision shifts his monitoring to the Tennessee court.
This decision marks a notable turn in a complex immigration case involving claims of wrongful detention and contested gang associations.
